1. Private beta and acceptance
These Terms govern access to and use of TruckBooker. By creating an account or using the platform, you agree to these Terms. TruckBooker is currently a private beta offered with free access during testing. Features, pricing, eligibility, and availability may change, and paid plans may be introduced later.
2. What TruckBooker provides
TruckBooker is a platform that helps food trucks, venues, event organizers, and customers find one another, publish profiles and schedules, and exchange booking requests. TruckBooker is not a party to any agreement, booking, purchase, event, or other arrangement made between users.
3. User responsibilities
Users are responsible for communicating directly and confirming all important details before relying on a listing or booking status. This includes pricing, deposits, refunds, payment terms, availability, menus, service details, expected attendance, permits, licenses, insurance, taxes, site access, utilities, health requirements, and other event requirements.
A booking-request status shown by TruckBooker does not replace a separate contract, deposit, payment, or direct written confirmation between the relevant users. TruckBooker does not currently process payments.
4. Accounts and business information
You must provide accurate, current account and business information and keep it reasonably up to date. You are responsible for activity under your account and for protecting access to your login credentials. Published profiles, schedules, menus, images, and other content must be information you have the right to provide.
5. Prohibited conduct
You may not misuse TruckBooker. Prohibited conduct includes:
- Impersonating another person or business or providing deceptive information.
- Submitting fraudulent, abusive, harassing, or intentionally misleading requests.
- Scraping, harvesting, or copying platform data through unauthorized automated means.
- Attempting to bypass access controls or access another user's private information.
- Introducing malicious code or interfering with the security, availability, or operation of the service.
- Using the platform in violation of applicable law or another person's rights.
6. Content and enforcement
You retain responsibility for content you submit. You permit TruckBooker to store, display, and process that content as needed to operate the platform. Accounts or content may be restricted, suspended, or removed when reasonably necessary to address abuse, security risks, legal requirements, or violations of these Terms.
7. Beta availability and changes
Beta access is provided without a guarantee that TruckBooker will be uninterrupted, secure, complete, or error-free. Features may be added, removed, limited, or changed during testing. Users should not rely on the platform for critical or time-sensitive bookings without confirming directly with the other party.
8. Warranty disclaimer
To the fullest extent permitted by law, TruckBooker is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. This includes implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and reliability.
9. Limitation of liability
To the fullest extent permitted by law, TruckBooker and those involved in operating it will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, business, opportunities, data, or goodwill arising from use of the platform or arrangements between users.
To the fullest extent permitted by law, total liability for claims connected with TruckBooker will not exceed the amount you paid directly to TruckBooker during the twelve months before the claim, or one hundred U.S. dollars if you paid nothing. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.
10. Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless TruckBooker and those involved in operating it from claims, losses, liabilities, damages, and reasonable costs arising from your content, your use of the platform, your dealings with another user, or your violation of these Terms or applicable law.
11. Termination
You may stop using TruckBooker at any time. Access may be suspended or terminated for violations, abuse, security concerns, legal requirements, or discontinuation of the beta. Provisions that by their nature should survive termination—including responsibility, disclaimers, limitations of liability, indemnity, and governing law—will continue to apply.
12. Governing law
These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict-of-law rules. Any dispute that is not resolved informally will be handled by a court with lawful jurisdiction in Colorado, unless applicable law requires otherwise.
13. Changes to these Terms
These Terms may be updated as the beta and platform evolve. The “Last updated” date identifies the current version. Continued use after an updated version becomes effective constitutes acceptance of the revised Terms to the extent permitted by law.
